| Judicial ceremony is an organic system that expresses and symbolizes the spirit and value of law and has the function of shaping legal authority.In practice,judicial ceremony is mainly reflected in the court building pattern,court layout,national emblem,robe,mallet and judicial language.Judicial ceremony has the function of cultivating legal belief,promoting the settlement of social disputes and shaping legal authority through indoctrination and discipline.In China’s judicial practice,there are some problems,such as lack of theoretical and institutional research on judicial ceremony,"extensive formalization" of judicial ceremony,non-standard behavior of participants in judicial activities,lack of professional language,and simplification of judicial ceremony by participants in judicial activities.This paper holds that the reasons for the above deficiencies mainly lie in the following aspects: the short development of judicial ceremony in China;The traditional ritual culture has limited the application of judicial ceremony to a certain extent.The participants in China’s judicial activities lack the understanding of the function of judicial ceremony in shaping legal authority.The idea and practice of valuing entity over procedure in judicial practice leads to the difficulty in the operation of judicial ceremony.Based on this,this paper puts forward the improvement measures from the following four aspects: to further improve the judicial ceremony system;To raise the importance of judicial ceremony to judicial organs;Improve the supervision and punishment mechanism for the participants in judicial activities;Through improving the professional quality of judges to achieve the importance of judicial ceremony. |
