Infant formula powder industry in China is one of the most rapidly growing industries in our country,the responsibility for China's tens of millions of infant and young child nutrition material,to improve the national physical quality,national development plays a very important role in the future,is the strategic industry to support the 123 industry,but the infant formula powder market in China has not been able to very good development,the smaller size of enterprises,the size of thousands of enterprises,the market has been in a state of excessive competition,blindly to price competition,lack of technical research,restricted the orderly development of the market,this issue after the melamine scandal broke out,Countries to formulate a series of subsidies measures to promote the adjustment of market structure,investment industry effective competition,in order to improve the domestic powder the overall competitiveness of the enterprise,but the original intention is good,but in the process of its formulation,the subsidies and its policy on the goal of the situation,lead to chaos in practice for disorderly stick is serious,not conducive to the orderly development of the market.This paper USES qualitative analysis to our country current infant formula powder enterprises subsidies to define,and using literature analysis method to explain the legitimacy of China's current subsidy policy,through to our country at present the government subsidies to these enterprises related documents and specific amount to make analysis,found the cause of this mess behind are various,such as not a relatively clear,there is no perfect assessment mechanism,also the lack of an effective supervision mechanism,and can be outside the scope of regulation in the law,at the same time,the judicial relief way also because there is no legal support and difficult.For the subsidy policy of infant formula powder enterprises in the development and implementation of the problems in the process of,based on the affirmation should use subsidy policy to promote the development of the infant formula powder enterprises at the same time,in order to make the subsidies measures can consistent with national subsidy policy goals should use the law to a certain regulation,although our country and no relevant laws and regulations in this aspect,but we can use the existing legal system to control it,first of all,should establish relatively clear subsidies standards,in order to promote the effective competition of the industry,in the direction of product development and quality efforts,In the formulation of subsidy standards,the enterprise scale,product quality and technology research and development should be comprehensively considered to determine the subsidy standards.Secondly,in order to make the subsidy policy truly effective,a comprehensive democratic evaluation mechanism should be established.Such an evaluation mechanism should include a comprehensive evaluation before and after the event to constantly revise the formulation and implementation of subsidy measures.At the same time,the democratic nature of the evaluation should be evaluated based on the opinions of enterprises,the public and experts.In addition,the supervision mechanism of subsidies for infant formula milk powder enterprises should be improved.This kind of supervision is firstly to establish the quasi-budget supervision mode in the budget law,which should be attached as the supplementary explanatory material of the government budget report.Secondly,the information disclosure between the government and enterprises should be strengthened to receive social supervision.Finally,it is necessary to improve the judicial relief channels in China and introduce the rationality review mechanism into the subsidies for infant formula milk powder enterprises,so as to solve the current lack of legal support for litigation in China.
