Research On The Construction For The Compensated System Of Rural Residential Land Use Right

For a long time,China has implemented the system of free use of rural residential land.However,with the development of market economy and the acceleration of urbanization,However,with the development of market economy and the acceleration of urbanization,many problems have arisen in the process of unnpaid use of rural residential land,such as excessive land occupation,idle land,and disorderly occupation of arable land,which has aroused concern for the construction of the system of paid use of residential land.So far,China has made two explorations on the system of paid use of residential land,the first in the 1990s and the ongoing exploration at this stage.At present,the pilot project of paid use of homestead is still in progress in an orderly manner,and has achieved many results.However,no reform will go smoothly all the time.It will inevitably encounter setbacks and difficulties.There are also some defects and shortcomings in the pilot project of paid use of homestead at this stage.Therefore,in order to make the system of compensated use of rural homestead be established smoothly,this paper takes the historical development of the system of compensated use of homestead as the starting point,uses the method of combining practical discussion with theoretical analysis to analyze the realistic basis and practical status of the system of compensated use of homestead,and puts forward the measures of constructing the system of compensated use of homestead.This paper consists of five parts:The first part elaborates the historical evolution of the rural homestead use right system.Firstly,the article clarifies the relevant concepts of the rural homestead use right system,and then combs the development history of the rural homestead use right system.The second part is the analysis of the necessity of establishing the system of paid use of homestead.Firstly,the article analyses the problems caused by the system of free use of rural homestead,and on this basis,it analyses the practical significance of implementing the system of paid use of homestead in China.The third part is the analysis of the legal and practical basis for the establishment of the system of paid use of rural residential land.This paper evaluates the feasibility of constructing the system of paid use of rural residential land in China from two aspects of legal basis and practical basis,and draws a conclusion that China can build the system of paid use of rural residential land.The fourth part is the empirical analysis of the reform of the paid use system of rural residential land.Firstly,this paper makes a comparative analysis of the purpose and basic situation of the two reforms in the 1990s and the present stage,and points out the shortcomings in the process of the pilot reform at the present stage.The fifth part is the suggestion on the construction of the paid use system of rural residential land in China.For the construction of the paid use system of rural homestead in China,this paper puts forward some suggestions from the aspects of the construction of the paid use system of rural homestead itself,the construction of the paid use fee system of rural homestead,the relief mechanism of the paid use system of rural homestead,and the construction of corresponding supporting facilities.
