Research On Temptation Investigation System In China

As a widely used investigative measure in China's criminal investigation practice for a long time,it was not until the introduction of the criminal procedure law in 2012 that it was clearly confirmed by the law for the first time.Its rules,however,have only made what would otherwise be a matter of stealth a matter of surface ambiguity.The reason why I choose to study temptation investigation in drug crimes is as follows:firstly,temptation investigation is mostly used to detect drug-related crimes in practice;secondly,except for a few words in the criminal procedure law,the supreme people's court and judicial organs at all levels have only made provisions in drug cases.A system of as lawmakers in the design of a "game",its original intention is good,just on the legislation technology not mature enough,that is,the temptation investigation system is chaotic,is not the system itself,but in the"game rules"lack logicality,temptation investigation is a double-edged sword,we need to do is fruity burnish of this rule,as far as possible big highlight its good side,in order to under the condition of the minimum damage to the rights of citizens to realize the biggest value of temptation investigation.Specifically,it should be started from four aspects:defining the investigation subject of temptation investigation and the applicable case situation,standardizing the initiation procedure and implementation mode of temptation investigation,strengthening the examination and supervision of temptation investigation,stipulating the right relief of illegal temptation investigation,and clarifying the responsibility subject and form of illegal temptation investigation.
