Jurisprudential Study On Mutual Checks And Balances Between Prosecution And Defense In Criminal Proceedings

Due to the influence of the criminal trial structure in all countries of the world,the criminal procedure law of our country has introduced the mechanism of prosecution and defense confrontation in the trial.At present,the adversarial structure of criminal trial in China has a legal basis for the development of trial-centeredness,and all parties in the legal field are actively creating conditions for realizing the substantive trial.But there is still a long way to go before the prosecution and defense can really achieve mutual checks and balances.We need to realize that it is difficult to achieve the interaction between the prosecution and the defense,to strengthen the role of the defense's out-of-court speech on the prosecution's checks and balances,and at the same time to ensure the effective expression of the defense in all aspects of the criminal defense,only in this way can the prosecution and the defense truly achieve interactive counterbalance.
