There are three industrial revolutions in the history of human development,each one brought mankind into a brand new world.Nowadays,artificial intelligence(AI)has been applied in various fields such as teaching,medical,home,logistics,finance,etc.The arrival of AI era will drive the wheel of human development to another unpredictable front The wide application of AI technology not only improves work efficiency,but also achieves many extraordinary achievements,while the problems it brings to social development are undeniable.From intelligent robots,drones to self-driving cars,AI has caused many injuring or death accidents,how to determine AI creations;how to protect personal privacy,life and property safety in big data era;some people worry that the advent of AI era will wipe out the creation of mankind in history,even dominate human beings,make people a slave to robots like the science fiction movies.The solution of the above problems depends on the answer that whether AI is the subject or the object in legal sense.The content of this paper is divided into four chapters:the first chapter makes a brief introduction about the definition,classification,development and application of AI,differences between AI and human intelligence.By comparing the legal regulation status of AI between China and other countries,regions,we realize our regulation system is not perfect enough.The second chapter expounds the problems brought by development and application of AI represented by intelligent robots,such as the impact to traditional subject-object system,the challenge to rights system,the dilemma of data information protection,the related issues of tort liability and the predicament of AI supervision.The first thing is to define whether AI can be the subject in legal sense,then we can solve the above problems.In the third chapter,we analyze that on the one hand AI doesn’t satisfy the independence,sociality,equality and legality,it doesn’t conform to the subject in philosophical sense,on the other hand AI possesses objectivity,controllability and usefulness.We draw the conclusion that AI should be defined as the object.In the fourth chapter,under the premise of the object status of AI,we propose the response path of legal problems brought by the development of AI,including the right of AI creation,protection of user data,the responsibility of AI infringement and the suggestions for improving AI supervision.
