Target Setting And Realistic Considerations For Graded And Categorized Handing Of Letters And Visits

As a unique democratic political system for expressing and resolving disputes in China,letters and visits play an important role in realizing rights relief,consolidating political power and maintaining social stability.However,in reality,even if some legitimate claims can be resolved,people habitually follow the channels of letters and visits.When people want to resolve appeals,the extreme choice of letters and visits not only spills over the scope of the right of relief of letters and visits,but also causes the imbalance between various relief channels,so that various relief channels cannot coordinate and cooperate with each other to solve the problem.The pattern of multiple relief for the people's demands cannot be formed.With the comprehensive advancement of the Strategic plan for the rule of law,the reform of the legalization of letters and visits has also been put on the agenda.The Party Central committee proposed to include letters and visits in the rule of law,promote the reform of the work system of letters and visits,and implement the graded and categorized handing of letters and visits according to law,which is of great significance for the construction of a multi-disciplinary relief mechanism.Through the graded and categorized handing of letters and visits,governments at all levels,judicial channels,administrative statutory channels,and letters and visits will give full play to the unique roles,as well as,in resolving disputes,complementing each other,and jointly solving the people's legitimate demands and maintaining social stability and harmony.This paper starts with the graded and categorized handing of letters and visits in the current reform,and clarifies the objectives that it expects to achieve in terms of politics,law,and management.In practice,in order to achieve those goals,we should take specific measures,such as the separation of litigation and petition,plaiting the list of statutory appeals,the supplementary role of letters and visits,step by step to for help according tolaw and accept the appeal hierarchically.However,the graded and categorized handing of letters and visits still have constraints on the three aspects of concept,system and mechanism,which affect the realization of the expected goals.so,a specific optimization path is proposed for eliminating these three constraints.Only establishing legal thinking,perfecting the design of system and mechanism,clarifying the working boundaries,working rules and connection methods of the three types of channels is the right way of the reform of letters and visits,and the basic content of the construction of the rule of law.
