Research Of Case-filing Registration In China

As an important milestone in the process of the rule of law in China,case-filing registration system immediately solves the problem of "difficult case filing",resulting in higher litigant satisfaction in case-filing process and significantly less visits,calls and letters about case-filing complaints.However,many problems are exposed after over three years' implementation of case-filing registration system,especially in the field of civil trial,such as surge in case quantity,more prominent disproportion between case quantity and manpower and abuse of action right due to lower case-filing threshold.The main reason behind is due to case-filing registration system is established without sufficient supporting system,which results in influx of all kinds of cases without screening.At the same time,there is not enough attention paid to other dispute-solving solutions beyond judicial approach.In light of these and also deepened judicial system reform,we still need to explore and study how to establish a dispute settlement mechanism that is more in line with the law of legal system to protect litigants' rights to the maximum extend and develop China's civil trial in a sophisticated and scientific way.
