Study On The Legal Regulation Of Urban Road Non-motorized Vehicle Traffic Problem

Non-motor vehicles,with their advantages of low-carbon,environmental protection and convenient travel,are becoming a major force in urban transport,effectively solving the problem of short-distance travel for citizens.However,illegal traffic caused traffic accident and disrupted traffic order,which affected traffic safety and smoothness,and even bring pain and disaster to many families.The purpose of this paper is to find an effective way to solve the problem of non-motor vehicle traffic in the city road from the legislative and law enforcement aspects.Firstly,this paper starts with the current situation of non-motor vehicle traffic problems in urban roads,and introduces the characteristics of non-motor vehicle traffic violations and the dangers of causing serious traffic accidents and destroying traffic order by summarizing the mixed traffic conditions of bicycles,shared bicycles,electric bicycles,electric scooters and ba anced vehicles.Secondly,the existing problems of the legal regulation of non motorized traffic in urban roads are fully discussed.It mainly includes four aspects:first,the single traffic penalty for non-motor vehicles,the absence of mandatory wearing safety helmet and "distracted driving " and uncertainty of traffic safety education the absence of compulsory insurance and of other laws and regulations are incompleteness;second,electric bicycles,electric scooters,flat cars difficult to manage;third,the way of administrative enforcement of law,such as the " stage management ","management blind area " and”huge crowds strategy " cannot solve the illegal problems of non-motor vehicles;fourthly,there are some problems in road traffic construction,such as non-motorized vehicle lane discontinuity,inadequate width,unreasonable signal lamp setting,and non-standard equipment for separating machinery and non-motorized vehicles.Finally,aiming at the problems in the second part,the paper puts forward the policy to perfect the legal regulation of non-motor vehicle traffic on urban roads,that is,to enrich and complete the regulations of non-motor vehicle penalty,traffic management,safety education,compulsory insurance and other systems,to make up for the shortage of norms;to improve the management system of electric bicycle,electric scooter and balanced vehicle,and to solve the difficult problems of management of special vehicle types;to establish a long-term non-motor vehicle law enforcement management system,complete the closed-loop management measures,strengthen the application of scientific and technological means.Continuous innovate administrative means,increase the intensity of administrative law enforcement;by optimizing the design of non-motor lanes and road traffic facilities,the right of non-motor vehicles are protected,the traffic management problems are solved,and the increasingly complex city road traffic environment are changed.
