Research On The Registration Requirements Of Sound Trademarks

With the progress of science and technology and the development of economy,the form of trademark has been innovated from the traditional sense of words and graphics to a more multi-dimensional and three-dimensional direction.Lots of new trademarks have emerged,including sound trademarks.By searching the data published on the official website of the national trademark office,the author finds that the current situation of application and review of sound trademarks in China is that the concentration of applicants,and the number of applications increases year by year,but the total number is small,and the approval rate of registration is extremely low.The reason is that Chinese sound trademark started late,the relevant legal provisions are not perfect,judicial practice is not operational enough.In order to deal with this problem,we should start with the registration requirements of sound trademarks.Drawing on the practices of other developed countries and regions,and combining with the judicial practice in China,the author proposes three improvement measures,which are improve the sound trademark publicity retrieval platform,limit the minimum use time before the application of sound trademark registration,and improving the chain of examination of trademark bureaus,trademark review committees,courts,experts and the public.It is expected that sound trademark registration legislation system in China can be improved to create a good legal environment for sound trademark development.
