An Empirical Study On The Execution Of The Larger City Legislative Power

The revised "Legislation Law" in 2015 gives all cities with subordinate districts(hereinafter referred to as "district-based cities")the local legislative power.However,with the expansion of the legislative body,the larger cities are also included in the district-based cities.The 49 former larger cities(hereinafter referred to as “larger cities”)had no legislative restrictions except for the principle of legal reservations,but now they can only enact the law on “urban and rural construction and management,environmental protection,as well as history and culture protection”,but these three categories contain excepted and existing matters compared with that of the district-based cities.How to comprehend the three categories of matters stipulated in Article 72 of the Legislative Law is the key to effectively preventing local over-legislation and improving the local legislative system.As such,based on situation of the “enactment,review and abolishment” of local laws and regulations after the optimization of the “Legislative Law”,we should focus on the formulation of local laws and regulations,and investigate legislative activities in larger cities in the past four years.It is crucial to disclose problems and put forward suggestions from perspective of the current legislative power.The local legislation in our country has made huge progress with more entities and greater system since its emergence.Reviewed as the "Legislation Law" in 2015,the larger city legislative powers still face “red tape”.As for the legislative implementation of the larger cities,although it follows the principles of legal and democratic legislation established by the Legislative Law,and strives to achieve scientific legislation,there is still legislation beyond the power,suspected of touching legal reservations,and violating the superior law.Moreover,the larger cities also have differences in legislative initiative.In addition,there are cases of over-legislation and plagiarism in terms of legal legislation,low public participation and imperfect information disclosure with regard to democratic legislation,as well as underperformed techniques,theories,and capacity in the aspect of scientific legislation.In order to further improve legislation in larger cities,the legislative power should be clarified,legal legislation intensified,democratic legislation strengthened,and scientific legislation upheld.All these efforts help optimize the legislative condition and capacity of the larger cities,improve the democracy and science of the local legislative power,and ensure the quality of legislative implementation in the new era,which will realize the transformation from legal legislation to great law and governance.
