Research On Judicial Review Of Cases Of Information Disclosure In Colleges And Universities Based On Application

With the promotion of government information disclosure,the demand for information is rapidly increasing.Not only is government information needed to be disclosed,but in universities,students have increasing demand for information that is closely related to them,which requires universities to make information public.Information disclosure comes in many forms,as an important part of information disclosure,application-based disclosure is a supplementary form of active disclosure,and one of the most important ways of information disclosure.Defining the implications and standard of information in colleges and universities is the premise to study the information disclosure system in universities.The information of colleges and universities is generated in the process of social public services and school work in universities,whether it is public colleges or private ones.There is a difference between university information and government information,which is precisely the specific point of the university information.It is in this way that the case of university information disclosure according to application occurs.In the case database,the author collected 17 judicial documents of information disclosure upon application in colleges and universities,and summnarized several legal issues in judicial review of such cases,including the cognizance of "three needs",the conditions for the party's application for disclosure of university information,the scope of the application-based information disclosure,and the censorship of secrets.By analyzing the process of judicial review in such cases,this paper finds the issue of judicial adjudication,sorts out the judicial review ideas of application-based information disclosure in colleges and universities.Combining relevant laws,regulations,judicial interpretations and cases,the qualifications,trial standards,legality of procedures involved in judicial review of such cases are discussed in detail.The following five suggestions are given to improve judicial review support system of application-based information disclosure,including reinforcing the legal basis,strengthening the legal conduct of the defendant,defining the scope of information disclosure and the judicial review of the "three needs",establish a censorship system for secrets,and developing university information disclosure compliance guidelines.I hope that I can provide some references for the judicial review of such cases,give support for improving judicial relief of the application-based information disclosure of colleges and universities,and contribute to the development of relevant legislation.
