The Research Of Protection Of Farmers’ Land Rights In The Development Of Rural Tourism

Rural tourism development momentum is swift and violent,but in the process of development farmers’ land rights and interests are violated,some problems restrict rural economic development,and also propose test for development of rural tourism in the future.This paper bases on the reality of the rural tourism development in our country at present,through the current situation of protection of the farmers’ rights and interests with developing of rural tourism,analyzes the related reasons,and puts forward countermeasures of protecting farmers’ land rights and interests.First of all,this paper expounds the concept of rural tourism,and introduces the development mode and the characteristics of rural tourism development in China.Ensure finding the relationship with stakeholders and impact on farmers’ land rights and interests of rural tourism,clarifying the content of the farmers’ land rights and interests with rural tourism developing,forming the macro viewpoint of the research object.Secondly,this article starting with the current situation of land use,in order to land circulation and land expropriation as the clue,discussed the problems of peasant rights and interests safeguard in current situation with the rural tourism developing.Farmers losing life safeguard because of land expropriation,and failed to get through land circulation expected returns,there are a lot of problems.Again,this paper analyzes subjective reasons and objective reasons of the of farmers’land rights and interests with rural tourism developing,due to farmers’ own limitations and defects in legal system,government service function dislocated,market development is not mature,leading harm for farmers’ land rights and interests in the rural tourism development.Finally,this paper gave the some suggestions such as from perfecting the farmers themselves,system innovation,reasonable solve the dispute over the land rights and interests,and how to role government to protect farmers’ land rights and interests of developing rural tourism in our country from being violated,in order to solve the present problems,avoid the damage in the future.
