Research On Public Participation In The Drafting Of Bills

In the report of the 19 th National Congress of the Communist Party of China,the goal of promoting democratic legislation and promoting development with good law was put forward.The promotion of public participation in legislation is an important way to achieve democratic legislation.The study of public participation in the drafting of bills is a refinement of public participation in legislation.At present,the academic and practical departments have a certain understanding of the particularity of the public participation in the drafting of the bill.Starting from the actual national conditions of our country,it is a topic worthy of attention to ensure that the public participates in the drafting of the bill effectively according to law.This article explores public participation in this particular aspect of drafting the bill.The normative basis for public participation in the drafting of the current bill is the principled norms in the Constitution and the specific norms in administrative legislation.The public participation mechanism has achieved certain results.A variety of ways to participate have been used effectively.If the written request for comments is widely used.The argumentation meeting and the hearing will play a certain role.The scope of application of the national discussion method has gradually expanded.Multi-agent collaborative drafting methods have been usefully explored.But the mechanism also exposed some problems.The scope of application of the public participation mechanism is not clear,the public participation mechanism is not running smoothly,and the degree of public participation is insufficient.The drafting of the public participation bill has no practical effect.Through the above analysis,suggestions for perfecting the mechanism are proposed from the aspects of norm construction and system construction.First,improve relevant legal norms,including making up for legal gaps,making legal content more specific,and making legal design more scientific.Second,improve the supporting system.Including information disclosure system,hearing system,feedback system,expression mechanism and so on.Of course,there is also the cultivation and improvement of citizen participation consciousness and ability.In short,improving the effective participation of the public in the drafting mechanism of the bill is of great significance for advancing scientific legislation and democratic legislation.It has important theoretical and practical significance for building a rule of law China and improving its governance capacity.
