| As a legal system in our country,the system of presale of commercial residential building has been established over twenty years since introduced from Hong Kong,which has played an important role in relieving the shortage of funds in the real estate market in mainland China and promoting the rapid rise of real estate industry.But with the rapid development of economy and society,great changes have taken place in social contradictions and market environment.The loose policy requirements and congenital defects within the system of presale of commercial residential building,and the lack of government supervision responsibility causes numerous problems and disputes since the system has put into operation,not only affecting social harmony and stability,but also hindering the healthy development of the real estate market,leading to calling from all sectors of society to cancel the system of presale of commercial residential building.How to reform the system of presale of commercial residential building based on long-term development,strengthen the supervision of the system of presale of commercial residential building,practicably safeguard public interests,are new challenges to our government.The supervision of the system of presale of commercial residential building is a systematic project,not only need to optimize the system of presale of commercial residential building and its supporting policies,but also need to strengthen the supervision of the system of presale of commercial residential building.Among all supervision subjects of presale of commercial residential building,the government department is the most powerful one,which has irreplaceable resource advantages in supervision,therefore,strengthening the government’s administrative supervision of the system of presale of commercial residential building is the top priority.This paper based on the case of district rights protection in T city,analyses the specific problems in the operation of the system of presale of commercial residential building,explored the lack of government’s supervision responsibility.Based on the field study of T city,this paper analyses the necessity and feasibility of reforming the system of presale of commercial residential building,it is found that cancel the system of presale of commercial residential building in the short term at this stage for T city is not feasible.Therefore,T city should take progressive reform of the system of presale of commercial residential building,at the same time,strengthen its administrative supervision,in order to minimize the risks arising from presale and the possibility of damaging public interests,accelerate the healthy development of real estate industry,promote social fairness and justice,ensure the harmonious development of social construction and economic construction.This paper firstly points out the research’s background and significance of the system of presale of commercial residential building,analyses and summarizes the research status of the system of presale of commercial residential building at home and abroad,establishes the research framework,defines and clarifies relevant concepts after determining methods and innovations,and then,establishes the theoretical basis of this paper,and carries out research on this basis.Secondly,it analyses the current situation of presale of commercial residential building and specific division of labor of regulatory agencies,based on the actual administrative supervision of presale of commercial residential building in T city,analyses its main measures and achievements.Thirdly,through the analysis of the case of district rights protection in T city,it retrodicts the problems in the operation of presale system from the outcome,analyses the deficiencies of administrative supervision responsibility exposed behind these problems,and lucubrates the cause of problems.Then,based on the analysis of the full text,it puts forward feasible countermeasures for T city to perfect its administrative supervision for the system of presale of commercial residential building,after analyzing the feasibility of reforming the system of presale of commercial residential building in Tcity,puts forward the proposal of reforming.Finally,it summary and prospect the contents of the full text. |
