As an ancient judicial system,the jury system plays an important role in the judicial system of all countries in the world.However,jury is not only a judicial mechanism,but also a wheel of the Constitution;it is a beacon that shows people the freedom to live.By comparing the jury system of different countries,it is not difficult to find that the development and evolution of the world jury system is radiated from the British jury system.This kind of radiation is realized through two ways: First,through the early colonial expansion Transplantation,the second is the indirect impact of the legal system on other countries.The people’s jury system with Chinese characteristics has experienced a long period of development and finally achieved positive results.We used a single-line law,the People’s Jury Law,to fix the 13-year reform experience for future reference.In the history of human development,no system is perfect.We have been thinking about creating an ideal system,but we can’t actually do it.We must learn to endure it while enjoying the advantages brought by a system.China’s people’s jury system is such a system.We must use the opportunity of the implementation of the new law,study the results of the pilot reforms,dig deep into the problems existing in the pilot work,and find new breakthroughs on the basis of the extraterritorial jury system.To make up for its shortcomings.This paper is divided into four parts to discuss the improvement of the people’s jury system with Chinese characteristics.The first part,starting from the theoretical basis,mainly introduces the concept,characteristics and legitimacy of the jury system.The second part,starting from the outside,mainly discusses the two characteristics of the jury system,namely the jury system and the participation system;In the third part,through the review of the reform work in the pilot area and the analysis of the status quo of the latest legislation,the status quo of the system is briefly understood.The fourth part combines the pilot experience and the extra-territorial advanced system to make recommendations for the improvement of China’s jury system. |
