Research On The Legal System Of Safety Guarantee Of Online Vehicle Restriction

Along with the progress of the times and the rapid development of the Internet era,people's lifestyle is also increasingly rich.Today,people can say that time is like life,while traffic congestion and taxi queuing have become a major problem for people to travel.At this time,online car booking came into being,which greatly alleviates the social problem of travel difficulties.Online car booking is not only a social problem,but also a social problem.Operating mechanism is flexible,and the price is lower than that of ordinary taxis.People can book online taxis in advance,which not only saves time but also saves travel costs.For a time,it has become the travel darling of all groups.However,as the saying goes,all things are a double-edged sword.While the online dating car brings benefits to people,it also causes many safety problems because of the imperfection of its own mechanism.In my opinion,the reasons for this situation are as follows: firstly,the reasons for the platform itself,the internal management of the platform is not strict enough,and the system of the identity of the driver and the registration of vehicle information needs to be improved;secondly,the problems of the relevant regulatory authorities,which need to strengthen the supervision of the platform.Finally,the problem of the legal system,which is not perfect enough,gives criminals a chance to take advantage of.In order to solve all kinds of problems existing in online car booking,we should start from three aspects: online car booking platform,supervision department and legal system,and analyze and discuss them in order to solve the security problems of online car booking as soon as possible and fundamentally.This paper includes four parts.The first part is the introduction.This part mainly discusses the research background,significance,current situation at home and abroad,and the research methods and innovations of this paper.This paper mainly uses the methods of comparative analysis,comprehensive analysis and case analysis to analyze and elaborate.The specific innovations include comparative analysis of the legislative status of China and foreign countries,drawing inspiration,and the construction of the safety and security system of online car appointment in China.The following points are put forward: First,the government should do a good job in the supervision of administrative licensing fundamentally;Second,it is necessary to strengthen the administration.The corresponding accountability efforts of the government supervision departments,etc.The second part is an overview of the security system of online car appointment.This part includes two parts.One is to define the concept and characteristics of online car appointment,distinguish it from traditional taxi,and classify online car appointment.It is clear that there are four modes of operation for online car owners in the market,namely,taxi,express,private car and free-ride,but not all of them.The most serious problems in real life are the express cars and the downwind cars of private cars,which are also the main research objects of this paper.The other is the current legislative status of online car booking in China,which mainly analyses the "Interim Measures for Online Car booking" formulated by seven ministries and commissions.This part is mainly to provide a theoretical basis for the following articles.The third part is the analysis of the security problems and the reasons in the operation of online car booking.The author will discuss them from three aspects.The first is the security problems caused by the improper market access regulations of online car booking platform in the legal documents.The main three aspects are the low access conditions,less restrictions and even illegal administrative licensing of online car booking platform.Secondly,the security problems caused by the inadequate internal supervision of the online car-appointment platform.In this part,through the analysis of the two homicide cases,the author draws the conclusion that the access conditions of the online car-appointment driver are low,the audit and supervision of the online car-appointment platform are neglected,the evaluation information of the online car-appointment platform exposes users' privacy,and the security problems and reasons caused by the inadequate emergency response ability of the platform.Thirdly,there are some problems in the safety supervision of online car appointment.In this part,this paper will cite Jinan Chen Chao case to analyze the deviation of supervision guiding ideology,unclear supervision responsibilities and inappropriate supervision methods.The fourth part corresponds to the third part,and gives some suggestions on perfecting the legal system of the safety guarantee of online car appointment.I hope that through the discussion of these four parts of this article,we can make a little contribution to improve the legal system of safety guarantee of online car appointment.
