On Authorship Of Intellectual Achievements Of Artificial Intelligence

Today's artificial intelligence information technology(AI)has made significant progress,and Internet technology,big data,and automatic control,which are closely related to it,have developed rapidly.With the help of Internet technology and big data technology,AI can “cognize” and “perceive” external information like human beings and have sufficient “intake information” capability;the development of “deep learning” system makes AI "neural network" system similar to the human brain.The AI with "neural network" system has eight characteristics including but not limited to creativity,independence,unpredictability and external communication.The external manifestation is the reality with independent consciousness and emotional expression.The intellectual achievement generated by AI has originality and high literary and artistic value.However,it is controversial to talk about whether to give AI's intellectual achievements copyright protections,because these problems will affect the legal status of AI's intelligence achievements,thus affecting the development of the entire AI industry.The first part of the thesis begins with the development of AI,and describes the generation and development of AI,especially the corresponding copyright issues brought by the creation and development of creative AI.The "deep learning" system has changed not only the technological innovation,but also the impact on human inherent machine perception.The authorship of AI's intellectual achievements has also triggered people's reflection on the personality right of writing and rethinking the motivation theory.The second part of the thesis is to analyze the characteristics of AI's intelligence production through the analysis of the characteristics of the AI's intelligence production process,and to review the copyright law's requirements for the originality of the works and the requirements for copyright owners.The third part of this paper describes the dilemma faced by the protection of AI's intelligence results.The AI's industry involves a large number of relevant interest groups,including investors in AI's research and development,owners of AI,developers of AI's programs,and users of AI.From the theory of Locke's labor property force and Hegel's theory of free will,the author discusses the legitimacy of protection.At the same time,it starts from the incentive mechanism and puts forward the problem of the protection of AI.The fourth part of this paper,from the perspective of economics,explores the incentive mechanism and the theory of rational man,proposes the coupling model of the incentive system of copyright law,analyzes the social welfare effect of the copyright protection of intellectual achievements of AI,and seeks for a possibility to stimulate the development of AI's industry and balance social public interests.The fifth part of this paper is to explore the ownership of the copyright of AI intellectual achievements and analyze the feasibility of giving AI personality of copyright.Draw lessons from the American employment system to solve the problem of the ownership of the protection of AI intellectual achievements;Make use of the contract law mechanism to fill the gap of the existing law.
