Study On Legal Mechanism Of Cross-border Water Resources Sharing Cooperation Between China And ASEAN Countries

China-ASEAN is connected by mountains and rivers,with similar humanities and social and economic development,and mutual benefit.China-ASEAN has embarked on a series of cooperation and coordination mechanisms covering political,social,economic,cultural and environmental aspects,but many mechanisms,especially those related to Cross-border water resources in the environmental field,are still in their infancy.In recent years,China and ASEAN countries have strengthened exchanges and cooperation in the social and economic fields,and have also strengthened mutual exchanges and cooperation on the development and utilization of adjacent water resources or shared water resources,but many problems have not been effectively solved.The dispute over the rational development and utilization of water resources has been long-standing but has not made great progress.On the whole,China and ASEAN should focus on strengthening the cooperation of shared water resources and promote communication and coordination between the two sides in the sharing,utilization and management of shared water resources.In the process of developing and protecting shared water resources,China and ASEAN will achieve “fair distribution”,“reasonable utilization” and “coordinated management” to the maximum extent.At present,the legal mechanism for China-ASEAN water resources cooperation has been initially formed.It is necessary to further realize and improve the coordination mechanism,supervision mechanism and dispute settlement mechanism in sharing water resources to ensure the sustainable development of shared water resources.This paper starts from the basic connotation and characteristics of cross-border water resources sharing cooperation,through the comparative analysis and reference of the successful experience of international Cross-border waters cooperation,and then studies the necessity and legal basis of cross-border water resources sharing cooperation,and finally builds and Improve the legal mechanism for China-ASEAN cross-border water resources sharing cooperation.According to the above research ideas,the paper is divided into four main parts for discussion.The first part of this paper will summarize the basic characteristics of cross-border water resources between China and ASEAN,and analyze the basic connotation of the cross-border waters sharing cooperation from the conceptual level,legal level and cooperation content level,so as to sort out the Cross-border water resources.The connotation and extension of sharing cooperation.The second part analyzes the necessity and practice of international and regional water resources sharing cooperation,and draws on the experience of successful cooperation,aiming to provide experience for the construction and improvement of the legal mechanism of cross-border water resources sharing cooperation between China and ASEAN.At the same time,it demonstrates the importance and demand of China-ASEAN cross-border water resources sharing cooperation.By expounding the necessity of cooperation,it is clear that the cooperation and sharing of cross-border water resources between the two can not only ease conflicts,but also promote the economy interest.The third part sorts out and studies the legal basis of China-ASEAN cross-border water resources sharing cooperation,and clearly shows the legal basis of water resources sharing cooperation between China and ASEAN,and also lays a legal foundation for the construction of China-ASEAN cross-border water resources sharing cooperation legal mechanism.The last part analyzes the status quo,analysis and existing problems of the coordination mechanism,supervision mechanism and dispute settlement mechanism of China-ASEAN cross-border water resources sharing cooperation,and proposes a perfect plan.
