A Comparative Study On Social Investigation Cases Of Conditional Non-prosecution Of Minors Under Different Participation Degrees Of Judicial Social Work

The social investigation of juvenile justice system is the focus of juvenile work,adhering to the mind of juvenile justice education to save,providing important reference for criminal activities and education and correction work,to protect the legitimate rights and interests of juvenile to the greatest extent.The system of conditional non-prosecution and the system of social investigation are based on strengthening the role of judicial social work in the judicial system,with the guidance of the education,correction and evaluation of judicial social workers in the judicial system,providing professional social support for juvenile justice based on the principle of education first,punishment second,and integrating investigation,prosecution,trial,the way of correction promotes the combination of juvenile justice and judicial social work,which fully reflects that judicial social work is suitable to be embedded in the judicial field and promote the development of juvenile justice.The judicial social work is closely related to the juvenile justice education through the professional belief of altruism from the humanitarian point of view.The traditional practice of procuratorial organs is to rely on the procurators in criminal procuratorial work to educate the minors involved in crimes,and some achievements have been made.However,taking into account the status of minors,the particularity of the role of prosecutors and social role,it is difficult to rely solely on the education of prosecutors to carry out a comprehensive and systematic help and education of minors involved in crime.This article takes the minor involved in crime as the research object,takes the participation degree of judicial social workers in the social investigation of conditional non-prosecution of minors by L procuratorial organ in X city as the visual angleand analyzes whether the participation of judicial social workers in the social investigation can be used as a reference for the procuratorial organ to comprehensively analyze the criminal causes and the risk of recidivism of the minor involved in crime through case comparison.In order to provide reference experience for the judicial social work embedded in the judicial field,recommendations for embedding social work in the justice system.
