Research On Public Interest Litigation Pilot Problem Of Procuratorial Organs In Shandong Province

With the rapid development of social economy in China,more and more incidents of infringement on social public interests are happening,and the public’s call for the protection of social public welfare is becoming stronger and stronger.It has taken us nearly 30 years to gradually establish a public interest litigation system with Chinese characteristics.Especially in recent years,China’s public interest litigation system has experienced a leap-forward development from exploring pilot projects to legislative protection,from social groups to procuratorial organs.Public interest litigation has become an important relief measure to safeguard national interests and social public interests.The public interest litigation system led by the procuratorial organs gradually reflects its unique advantages.Shandong Province,as a pilot province of public interest litigation carried out by the national procuratorial organs,has made some achievements,but also exposed many problems.Through the analysis of the pilot work of public interest litigation of Shandong procuratorial organs,this paper objectively presents the development of public interest litigation of Shandong procuratorial organs,and deeply studies the problems that need to be solved urgently in public interest litigation of Shandong procuratorial organs.This is our country has just entered the fast lane of the construction of public interest litigation legalization.On the premise that there are still differences in understanding and execution of public interest litigation among procuratorial organs,we should carefully sort out the pilot work of public interest litigation of procuratorial organs in Shandong Province,so as to make the public interest litigation system of procuratorial organs in Shandong Province more perfect.Based on the current situation of public interest litigation work in China,this paper compares and analyses the characteristics of public interest litigation system in Canada,the United States,Germany and India,and combines the problems exposed in the pilot work of public interest litigation of procuratorial organs in Shandong Province,from improving public interest litigation system,reducing litigation costs,facilitating investigation and evidence collection,strengthening the construction of the ranks of procuratorial organs,and strengthening the construction of the ranks of procuratorial organs and the Ministry of Government Five aspects,such as cooperation between the door,social organizations and individual citizens,have put forward countermeasures and suggestions to improve the public interest litigation work of Shandong procuratorial organs.
