With the continuous development of Internet technology,human beings have come to the era of big data,intelligent travel,smart home,mobile payment...Everyone is constantly generating data,and traces of personal information are everywhere.China's network data production and data types rank high in the world.Driven by huge commercial interests,criminals have adopted a series of illegal means,such as data theft,information theft,phishing and telecommunications fraud.Seriously endangering the safety of citizens' personal information,causing huge economic losses and negative social impact.The protection of personal information has become a concern of the whole society.Developed countries such as Europe and the United States have always attached great importance to the protection of personal information and strengthened the legal protection of personal information.In the era of big data,the relevant personal information protection law has also been revised and improved.Due to the influence of social tradition and the low level of legal and economic development,China has recently begun to pay attention to the protection of personal information.Relevant laws and regulations of personal information protection are scattered in different fields of laws and regulations,and it is difficult to effectively protect personal information.According to the latest news,China's personal information protection law has been included in the legislative plan of the Standing Committee of the National People's Congress.China can make full use of the personal data protection law with Chinese characteristics in the era of big data.This paper begins with the basic concept of personal information in the era of big data,and then analyzes the legal attributes of personal information rights.Then,through comparative analysis of the legal system of personal information protection in the United States,Japan,the European Union and other countries and regions,according to China's National conditions,we find out the personal information protection model suitable for the National conditions,and put forward some suggestions for the planned personal information protection law.
