Outcomes Research On Juvenile Offender Probation

As the development and widespread use of punishment individualization,people become more concerned about the balance of positive and negative effect when inflicting punishment on criminal behavior.Probation system is the most direct embodiment of penalty mitigation.Actually,it has become a significant juridical practice all over the world,because of its characteristic of economical efficiency and humanitarianism,as well as avoiding cross infection,personality of prisoners and difficulty in re-socialization due to prison punishment.For juvenile delinquency,probation system occupies a more important position,for the reason that delinquents are young,immature and low-educated,which leads to single motive for crime and easier reform.And the common concern for minority around the world is also a non-negligible factor.However,after the in-depth investigation into probation system for juvenile delinquents,we(or I)find that probation system does not work as expected in personality correlation,prevention and reduction of re-offending.The paper is trying to explore a scientific and applicable approach for probation based on current legal system and code of ethics.The paper is organized as following sections.Introduction:Introduces the background of the subject,the concept and history of Probation,and also the way of research.Text:Section 1 discuss the necessity of probation system,differentiates juvenile delinquents and adult crimes according to physical and mental characteristic,cause of crime and reform possibility,and presents the conclusion that probation is more applicable in juvenile delinquency.Section 2 presents the empirical research on juvenile delinquency.The samples are from juridical practice in city Q,Yunnan Province,and the research contents include general applicable condition for probation,re-offending after probation of juridical delinquents,concentrated area for probation application and etc.By practice research,problems of probation application in juridical practice are raised.Section 3 presents the problems for delinquency probation,from the viewpoint of both top-level designs' deviation and deficiency,and juridical practice level's correlation and supervision.This section mainly focuses on practice problem-solving level.Section 4 presents the possible improvement and suggestions for delinquency probation.Considering the author's position and paper's propose,this section is based on current legal system and try to maximize the utility by scientifically suspending probation.Legislation,theory and applicability are not discussed in this paper.
