Research On Procuratorial Supervision Path Of False Litigation

False litigation not only damages the national economy interests,social public interests and the legitimate rights and interests of others,but also undermines the normal judicial order and seriously damages the national judicial authority and credibility.As the legal supervision organ stipulated by the Constitution,the procuratorial organs are the main force for punishing false lawsuits and a powerful weapon for restoring national economy interests,social public interests and the legitimate rights and interests of others,and safeguarding judicial justice and legal authority.The function of the procuratorial supervision of false litigation is strengthened not only because of the serious social harm brought by false litigation but also the advantages of the procuratorial organ as a special legal supervisory section.Compared with the court,the parties concerned with more advantages in legal and functional aspects easily identify and prevent false litigation.Starting with the handling of a false lawsuit as a perspective and entry point,this thesis explores the accurate definition of false litigation,analyzes the characteristics and causes of false litigation,and then discovers,identifies and solves problems in a targeted manner.It aims at offering some suggestions about strengthening the procuratorial organs' supervision of false litigation and enhancing the effectiveness of supervision,which contributes to judicial practice,safeguarding legal authority and social public interest.
