Study On The Problems Of Civil Subject Of Charity Organization

As part of the public governance structure,charity organization plays an irreplaceable role in the distribution of social resources and the alleviation of social contradictions.At present,we need to support the development of charity organizations,recognize the characters,clarify the legal status,and create a perfect legal environment.Recently,thriving charity activities has drawn our attention to the problem of the civil subjectivity of charity organizations,which restrict the development of charitable organizations accordingly.The promulgation of Charity law and General Provisions of the Civil Law,which has updated some supporting laws and regulations and shown some progress of the legal institutions,has brought changes to the legal regime concerning the subject of charity organizations,However,the effective mechanism which can promote the healthy development of charity organizations is far from well established concerning the current system environment And since the promulgation of Charity law,the implementation including the popularization and operability of it is not as good as we expected.In this paper,we will analyze some typical cases,summarize the problems of the civil subject of charitable organizations in China,track the history of the charity organization system,and try to introduce and analyze the civil subject system of charity organization in Anglo-American law countries,especially in the US.In comparative view,the problems in China is obvious and we will find solutions of these problems.I hope this paper may provide one or two humble opinions for the law changes in the recent future.
