With the continuous improvement of the living standards of the residents,the number of private cars has gradually increased,and the unreasonable pricing problems such as “high-priced parking spaces” and high parking service fees have been caused by insufficient supply of parking spaces.How to properly resolve such disputes is not only related to the legitimate rights and interests of stakeholders such as real estate development enterprises,property service companies and owners,but also related to the construction of a harmonious environment in the community,which is closely related to social harmony.The theoretical community has not paid enough attention to this practical issue,and this article has carried out related research.The introduction of this article is divided into three parts,the main contents are as follows:The first part summarizes the deficiencies of the current legislation on the ownership and pricing of parking Spaces in residential areas,and discusses and analyzes the pricing of parking Spaces in the current laws and regulations.Firstly,it points out that the "urban and rural planning law" on the provision of supporting facilities is insufficient,the construction subject should be the number of construction and construction standards did not make targeted provisions.Secondly,it analyzes the excessive principle of ownership of parking Spaces in the property law.The provisions of article 74 fail to fundamentally solve the ownership problem of parking Spaces.Thirdly,it is revealed that the provisions of the property management ordinance on the charging of property services also go beyond the principle of defining the standards and charging nature of parking services provided by property service enterprises.Finally,it is pointed out that the "price law" and other regulations do not pay attention to the pricing of parking Spaces and do not include the residential parking Spaces directly invested by developers in the range of government-guided prices.The second part points out the legitimacy of legal intervention in the pricing of parking spaces in residential quarters.The paper analyzes the pricing of existing property service enterprises or the pricing of developers in China,which leads to the confusion of the parking space charging market.It proves the legal pricing of parking space pricing rights through the theory of market failure,price theory,public interest theory and scientific development theory.The third part puts forward relevant suggestions and countermeasures for perfecting the pricing.It is considered that the fees for the parking spaces of residential communities by developers and property service enterprises should be included in the scope of the government guidance price,and the guidance for parking spaces in residential areas should be unified according to the consumption level of each region.Price,and form a differentiated residential parking space pricing mechanism based on the government guidance price,strengthen the owner's pricing participation rights,improve the pricing information disclosure system,thereby reducing parking space charging disputes.
