| This research is based on the perspective of the construction of legal system,trying to analyzes the existing legal system and supervision system of the banking cooperation across the Taiwan Straits.This study also notes the changes of both the international financial environment and the cross-strait financial environment,explores the possible impacts of banking cooperation on both sides of the Taiwan Strait under the new situation,and conducts in-depth study of the cooperative legal system for specific businesses.The study analyzes the cross-straits from various aspects and levels.We believe that the existing legal system and supervision of banking cooperation across the Taiwan Straits are insufficient.Facing the opportunities emerging under the new situation,both sides of the Taiwan Strait should take this opportunity to make arrangements for the institutional construction.They should improve the existing problems and grasping new opportunities,constructing a legal system for banking cooperation across the Taiwan Straits.The above measures are all for establishing a cross-strait banking cooperation legal system and formulating corresponding supporting laws and regulations and effective cooperation mechanisms for further cooperation between the two sides of the Taiwan Straits.Except for Preface and Conclusion,this article is divided into four chapters.The first chapter is mainly introduces the basic situation of the banking cooperation legal system on both sides of the the Taiwan Strait.The establishment of the cross-strait banking cooperation legal system can provide institutional guarantee for business cooperation,which is beneficial to the development of banks across the Taiwan Straits.It is also a common choice for the financial crisis.Therefore,the construction of the banking cooperation legal system on both sides of the Taiwan Straits is quite necessary.This section focuses on the current main legal norms and cooperation mechanisms of cross-strait banking business.It concludes a preliminary understanding of the basic outline of the banking cooperation legal system across the Taiwan Straits from the reality and legal aspect.Based on the content of the first chapter,the second chapter analyzes the main problems of the current banking cooperation legal system on both sides of the strait from the aspects of legal system and supervision system.The third chapter focuses on the impact of RMB internationalization and the Silk Road Economic Belt and the 21st-Century Maritime Silk Road("B&R")on cross-border banking cooperation,including the impact of cross-border RMB business,offshore RMB market in Taiwan,restrictions on foreign banking business,and the increase in bank financing business,strengthening supervision of overseas business of banks and so on.The fourth chapter is based on the above-mentioned shortcomings of the legal system of cross-strait banking cooperation and the existing problems on financial supervision,combined with the possible impact of RMB internationalization and the B&R,trying to make some suggestions to the construction of the banking cooperation legal system from two aspects. |
