| Family is the basic unit of ancient Chinese society.The stability of the family and the country will surely contribute to the peace of the country.In family life,there must be leaders,namely parents.Parents have the right to manage family property and control family members,that is,parental rights.Patriarchal power not only plays a role in adjusting family relations and maintaining family harmony,but also is an important breakthrough in the study of national political relations and feudal legal system.Tang Dynasty,as an era of highly integrated etiquette and law and incorporating ideas in Chinese history,its prosperous economic development,civilized social atmosphere and perfect legal system made patriarchal rights complete in this period.Therefore,through the study of the content of patriarchal rights in the Tang Dynasty,we can understand the legal basis and value pursuit of power operation,so as to better understand its impact on the Tang Dynasty society and the feudal legal system.This paper is divided into two parts: introduction and text.The introduction is mainly divided into the origin of topic selection,research status and research methods,as well as research innovations.The text is divided into three parts.The first part is an overview of patriarchal rights.Firstly,the concepts of "relatives" and "family" and the meaning of parental rights are clarified.Then it introduces the historical evolution of patriarchal rights and its causes.To clarify the development process of patriarchal rights and explore the reasons why patriarchal rights were so authoritative in ancient China.The second part is about the content of patriarchal rights in Tang Dynasty.Parental rights in Tang Dynasty were divided into personal rights,religious rights and property rights.Among them,personal rights are mainly manifested in the right of dominant marriage,which is further manifested in marriage,divorce and remarriage.The power of decree is divided into the right of family education,the right of punishment and the right of sending punishment.Property rights consist of property management rights,restrictions on foreign property and testamentary property rights.The third part is a summary of the patriarchal rights of the Tang Dynasty.Firstly,it analyses the legal basis of the operation of the patriarchal power system in Tang Dynasty.Including: etiquette as the criterion,patriarchal hierarchical privilege principle requirements,China’s ethical outlook.Then,it analyses the characteristics of parental rights in Tang Dynasty.Mainly include: legalization of parental rights;expansion of parental power;duality of rightsand obligations;highlighting filial piety ethics;women have certain family management rights.Finally,the influence of patriarchal rights in Tang Dynasty on ancient Chinese society is analyzed.Its influence on the society of Tang Dynasty and its influence on later generations of Tang Dynasty.In summary,the research on the patriarchal rights in Tang Dynasty,combined with the laws and classical books at that time,tries to restore the real situation at that time,and finds that patriarchal rights not only affect the feudal legal system,but also permeate all aspects of ancient society. |
