This article takes a house demolition case as an example,and discusses the legal relationship between the parties involved in personal injury compensation and how the parties under such legal relationship bear responsibility.It is hoped that it can provide reference for judicial practice.The main content of the article is divided into three parts,which are:The first part makes a brief statement on the case,sorting out and the focus of the case.The second part is based on the specific analysis of the focus of the previous dispute.The author believes that the Bureau of Land and Resources has no direct contractual relationship with Lu,the deceased in this case,and cannot therefore waive its responsibility in the accident involved.The Bureau of Land and Resources and Qiu will be jointly and severally liable;The legal relationship between Chen and Lu is recognized as a personal partnership,which is different from the employment relationship determined by the court.Based on the personal partnership,Chen assumes the responsibility of the partner.The third part is about the responsibility of the responsible subject in this case of personal infringement due to different legal relationships,including the determination of the responsibility of the consignor in the contract,the judicial determination of the individual partnership and the interpretation of the court.
