On Determination Of Damages For Patent Infringement

With the advent of the era of knowledge economy,intellectual property infringement cases emerge in an endless stream,especially patent infringement cases.At present,in patent litigation cases,one of the issues concerned by the parties is how to determine the specific amount of damages,which is also a hot topic in intellectual property theory and practice.The amount of compensation for damages has attracted much attention because the determination of the amount of compensation is directly related to the fairness of the judgment of the case,and judicial justice directly affects the enthusiasm of the public to apply for patents and exercise patent rights.Therefore,it is necessary to conduct in-depth and detailed research on the compensation for damages caused by patent infringement.The author takes the theory of patent infringement as the research foundation,and the specific cases in current practice as the main research point,studies the current situation of patent infringement damage compensation in China,analyses the main problems in practice,and puts forward the corresponding solutions to the problems in practice.It is hoped that the author’s research can improve the scientificity of the current calculation method of patent infringement damages,further improve the judicial credibility,and better protect the interests of patentees.
