Research On Looking For Stakeholder In Bribery Case

On November 4,2017,the Standing Committee of the National People’s Congress(NPC)passed the decision to Promoting the Pilot Program on the National Supervisory System Reform all over the Country,the Supervisory Commissions has become the only anti-corruption agency in China.On March 20,2018,the NPC passed the Supervision Law of the People’s Republic of China.According to the Law,the Supervisory Committee is the responsible organ for exercising the functions of supervision,which is responsible for supervising all public officials exercising public power,investigating duty violations and duty crimes.Because of the particularity of investigation activities,the supporting system is not perfect,the investigative means given to the Supervisory Committee are not abundant,and most rely on the cooperation of other agency,which determines that the investigation work of the Supervisory Committee can only focus on the peripheral investigation.In addition,as the Supervisory Committee is currently facing the problem of a huge number of cases,the investigation can only be completed within a short period of time.How to effectively complete the investigation work is a difficult problem for everyone in the Supervisory Commissions.Bribery accounts for the highest proportion in the cases of duty violation and duty crime.The core of investigating bribery cases lies in looking for "people" "things" and "money",while looking for stakeholder is a shortcut in investigating bribery cases.This paper summarizes the methods of looking for stakeholder,and strives to play an important role in the investigation of bribery cases.The first part of the paper outlines the origin and characteristics of the investigation work,and focuses on the core of the investigation work,reflecting the investigation work needs to find out an efficient method—looking for stakeholder.The second part mainly talks about the concept,significance and work requirements of the method of looking for stakeholder,and introduces the method from the macro level.The third part introduces in detail eight methods,which basically covers the common ways used by all the Supervisory Commissions,including:public security information system inquiry,bank statements query,telephone lists query,real estate query,etc.The fourth part analyzes the situation of looking for stakeholder of the Standing Committee in the practice,and takes the data of half a year as the support.Itsummarizes the characteristics and highlights the advantages of looking for stakeholder;the fifth part puts forward suggestions for the improvement of the future investigation work.
