Implementation Path Study In Judicial Responsibility System Of Judges In Local People's Courts Of China

Judicial trial is the last procedural guarantee for a fixed dispute.Whether the judiciary is fair or not is directly related to the credibility of the judiciary.As a core member of the judicial trial,the degree of judicial exercise of the judge is related to whether the judicial justice can be realized.Therefore,the establishment and improvement of the judicial responsibility accountability system has become the proper meaning in the process of legal construction in China.China's research on judicial responsibility began at the end of the last century.The previous system of misjudged cases has evolved into today's judicial responsibility system,indicating that this system is gradually improving and improving.Although the law does not change,but it cannot lag behind,the construction of the judicial responsibility system is the need of the actual judicial environment,achieve the goal of judicial responsibility reform of "let the judges decide,the judges are responsible",to eliminate the existing drawbacks of judicial administration,to prevent unjust and false cases,to enable judges to handle cases independently,and to achieve judicial justice.Based on the reality of China's judicial responsibility system,the article elaborates on the reform of China's judicial responsibility system in four parts.Starting from the reality of the judicial responsibility system in China,the article elaborates on the implementation path of the judicial responsibility system of judges of local people's courts in four parts.The first part describes the theoretical issues of judicial responsibility system,what is judicial responsibility system,the characteristics,value and composition of judicial responsibility system,the three theoretical models of judicial responsibility system and the differences and links with other responsibility systems.Through understanding the basic theoretical issues of judicial responsibility,we will pave the way for building a comprehensive judicial responsibility system.The second part describes the current situation of the judicial responsibility system of judges of local people's courts in China,including the historical process and current situation of the judicial responsibility system.Only by grasping the evolution history and current situation of the judicial responsibility system,can we really find out the problems.The third part analyses the problems existing in the judicial responsibility system of the judges of the local people's courts in China.Only by finding out the existing problems of the judicial responsibility system,can the remedy be given to the case.The fourth part,aiming at the problems existing in the current judicial responsibility system,puts forward suggestions in four sections,including consolidating the legal basis,establishing a supporting system and protecting the rights and interests of judges,focusing on results to focus on procedural aspects.
