Research On China's Civil Electronic Litigation System

The Jilin electronic court was launched at June 19,2015.It indicates that the practice of electronic litigation in our province will be carried out in an all-round way.In fact,electronic litigation is not an independent litigation procedure,it is only a special way for the parties to express their claims and realize their rights,a more convenient,advanced and rapid means,but still based on the “Civil Procedure Law of People'sRepublic of China” and other procedural laws.This article mainly divides into three parts,the first part is to summarize the concept and characteristics of electronic litigation;the second part combines the current development of electronic litigation to elaborate the practical operation of various stages,embodied in five aspects,respectively: Set up a case online,trial a case online,electronic service,electronic files,electronic files,electronic.Big data and Wisdom courts.By comparing the situation before and after the implementation,the necessity,legitimacy and operability of the implementation of electronic litigation have been strengthened,and the significance of its universal application in the future has been strengthened.In the last part of this paper,through the grasp of the practical application process of electronic litigation,put forward specific measures to improve,but also the future operational ideas,whether in the formulation of rules,the application of technology or large data,large platform construction,there are plans and countermeasures,I hope that through research,for the electronic The construction of litigation contributes one force.The research method of this paper is mainly based on empirical research,combining with the author's actual work,collecting the opinions of court colleagues,investigating the user experience of litigation participants or lawyers,obtaining valuable feedback information,and systematically observing the advantages and disadvantages in the application of electronic litigation technology.It shows its application status objectively and accurately.In addition,comparative research and literature analysis are applied.Although the author's inadequacy in using other countries' languages leads to the fact that the foreign electronic litigation system and content known in the process of writing are all from the relevant domestic literatures,it is also sufficient to grasp some advanced systems in other countries and screen out the advanced ones.Many valuable experience,while comparing other domestic courts have opened electronic litigation,a comprehensive and comprehensive understanding of the issues to be studied.The research method of this paper is mainly based on empirical research,combining with the author's actual work,collecting the opinions of court colleagues,investigating the user experience of litigation participants or lawyers,obtaining valuable feedback information,and systematically observing the advantages and disadvantages in the application of electronic litigation technology.It shows its application status objectively and accurately.In addition,comparative research and literature analysis are applied.Although the author's inadequacy in using other countries' languages leads to the fact that the foreign electronic litigation system and content known in the process of writing are all from the relevant domestic literatures,it is also sufficient to grasp some advanced systems in other countries and screen out the advanced ones.Many valuable experience,while comparing other domestic courts have opened electronic litigation,a comprehensive and comprehensive understanding of the issues to be studied.In a word,electronic litigation is the influence and infiltration of electronic network technology to judicial trial work,and it also includes a way for litigants to use electronic technology to conduct litigation activities.It is sparking technological changes in the judicial field,and will certainly affect the future direction of the litigation system.
