| In recent years,the intensifying of racial problem,ethnic conflicts and regional conflicts and the expansion of religious and terrorist forces greatly increase the refugees number across the world.In 2014,the refugee crisis in Europe,more than millions of people passed Mediterranean and came to Europe.Such large scale refugee flow caused deep and profound influence to European area and attracted world attentions.In order to strengthen the controlling on illegal immigrant,attack illegal immigration,and prevent terrorist invasion,various countries begin to strengthen controlling on maritime bordermaritime interception is one of the important measurements.However,under the background of mixed migration,such measurements often damage the legitimate interests of refugee and breach the non-refoulement principle in refugee law.How to protect the rights of refugee while maintaining the country’s interest become an urgent problem.The target of this thesis is to employ maritime border controlling and refugee protection regulation as the basics of research,to comprehensively discuss the theories of maritime border controlling and refugee protection regulation,to analyze their conflicts and find out a coordination way.The author will collect relative reality conditions and historical situations,and analyze,compare and integrate the collected documents based on the research.Through discussion on the maritime border controlling concept and the refugee protection regulation composition,the thesis concludes their logic relation,analyzes the challenges brought by maritime border controlling to refugee protection regulation,and provides suggestions to how to coordinate their relation.Through discussion,the author prompts that be based on relative international laws,develop regional and global cooperation,and strengthen the intervention effect of international organization are the effective ways to coordinate maritime border controlling and refugee protection.This paper is divided into three parts.The first part is about the maritime boundary in the context of mixed immigration and to discuss the concept of central mixed immigration and maritime boundary control in this paper.The second part is about the challenge of marine border control to the refugee protection system,and will introduce the formation of refugee protection system,discuss the conflict of maritime boundarycontrol and refugee protection system from four directions,namely the principle of non-push,asylum application,refugee placement,secondary movement.The third part will give suggestionsto maritime boundary control and refugee protection system from the three directions of international law,international cooperation,and international organization based on the pre research. |
