Judge Criminal Wrong Case Responsibility Investigation System

In order to further promote the judicial reform,improve the quality of judges handling cases,ensure judicial justice and maintain judicial credibility,the system of investigating the responsibility of misguided cases of judges arises at the historic moment.As an important basis of the system of investigating the judges’ responsibility in wrong case,the opinions of the Supreme People’s Court on perfecting the judicial responsibility system of the Court gives general guidance on what circumstances should be investigated,what punishment procedures should be adopted,and what punishment measures should be given and establishes the conception blueprint of our country judge criminal wrong case responsibility investigation system.However,looking at the current judicial situation in our country,some unjust and false cases caused by the unfair adjudication of judges are still continuous,in spite of bans.These criminal misdeeds have seriously infringed on the legitimate rights and interests of citizens and destroyed the realization of social fairness and justice seriously weakened the judicial credibility and our legal authority.In addition,our country standard of responsibility for wrong cases by judges is low according to the validity rank,and lacks the unified wrong case confirmation standard.The pursue responsibility procedure lacks the standard,and the wrong case responsibility investigation scope is too broad.These existing problems will seriously affect the practical effect of the investigation of the wrong cases of judges.Therefore,it is necessary to speed up the improvement of the system of investigating the responsibility of the judges in criminal malpractice cases in our country.From the point of view of the meaning of criminal miscarriage of justice,starting from the specific contents of the system of investigating the criminal error of a judge and taking its legal value as the basic point,this paper will analyze the causes of the miscarriage of criminal cases in our country.This paper will deeply analyze the problems faced by the system of investigating the criminal wrong cases of judges in our country,and then put forward some concrete measures to perfectthe system of investigating the criminal improper cases of judges in our country,such as the establishment of operational standards for the identification of erroneous cases,the establishment of specialized criminal malpractice accountability institutions,the standardization of the operation of the judges’ disciplinary committee,the establishment of a special system of ensuring the identity of judges,and the establishment of a perfect system of exemption of judges’ responsibilities,and so on,to make sure our country judge criminal wrong case accountability system will development effectively.
