| The Warren Court was the U.S.Supreme Court that was named after the Chief Justice Earl Warren between 1953 and 1969.Warren Court made many classic decisions in the field of racial equality,anti-McCarthyism,distribution of representation,freedom of speech,criminal procedure and so on.It caused a series of constitutional changes,and it evoked the changes of the American society and civil life.It is really worthy of our attention and making research that how the Warren Court made these famous judgments and what impact these judgments had on the American society.This paper chooses the following cases and is about the discussion on the following five areas:The first part sums up the case and the decision of Brown v.Board of Education.And it summarizes the historical background and the reason.And then it discusses the positive impact,which the Warren Court made in racial equality in American society.All in all,the Warren Court desegregated in public education.It made an important difference on promoting equality of education,the American civil rights movements and to further desegregate.The second part includes the acceleration of anti-McCarthyism made by Warren Court,which focuses on Yates v.United States.Because of the Cold War and McCarthyism,the United States was once in a frenzy of anti-communism.However,in the process of anti-McCarthyism,"Domestic Security Plan" was gradually disintegrated and the rights and freedoms of citizens by the judicial activities of Warren Court.The third part concludes the judgment of Baker v.Carr in the first place.This case is mainly caused by the development of urbanization.Urban dwellers’ right to vote was damaged because rural residents dominated the State Legislature.Besides that,the unfair distribution of seats existed in many states.Secondly,it discusses Warren Court has a positive effect on correcting the unfairness of the seats in the United States.Warren Court interferes in the unfair distribution of seats to achieve ‘one man one vote’.The significance of the case is not only to protect the right to vote of citizens,but also to make efforts to American democracy.The fourth part discusses how Warren Court promoted freedom of speech in American society,which based on the famous case ——New York Times Co.v.Sullivan.In this case,the Warren Court established Sullivan Standard,which said only when the suspect’s defamation behavior and actual malice are confirmed,is he found guilty.Warren Court made constant efforts for the right of freedom of speech of the American citizens in the series of cases,and it is benefit to the discussion and supervision of public affairs.The fifth part introduces Miranda v.Arizona.And the protection of the criminal defendant rights and criminal process made by Warren Court is discussed.In the process of guaranteeing the rights of criminal defendants,Warren Court extended Bill of Rights to the states,including the rule of evidence,the right to counsel,the right to keep silent,and the right to a jury trial.The final part is a conclusion that emerges from all above discussions.This paper chooses these typical cases of Warren Court from the aspect of racial equality,anti-McCarthyism,distribution of representation,freedom of speech and the relative rights of criminal defendants.It aims to discuss what positive role the Warren Court plays in American society.And it is expected a possible analysis and discussion in depth on this issue. |
