Application Of Lie Detection Technique In Criminal Procedure

Long time ago,the technology of lie detection had existed,at present,the technology of lie detection has applied mainly in mood,psychology and physiology,and cognitive neuroscience these aspects,the most important among them is the technology of lie detection in psychology and physiology.The conclusion of lie detection must accord with legality,relevance,objectivity and harmlessness,otherwise,the phenomena that obtaining the confession of criminal suspects illegally,infracting their lawful rights and interests,even unjust,false and erroneous cases will probably happen.In our country,the conclusion of lie detection is not used as evidence in criminal action but to help examine and judge the evidence.Even in the United States with better development of lie detection,it is limited as well.On the whole,the conclusion of lie detection has gained more and more recognition.There are three viewpoints including positive,negative and partly adopting in the academic circles about the power as evidence.If the conclusion of lie detection can be used as evidence,the first thing to do is to classify this to one kind of evidence.For the nature of lie detection,there are different opinions,for example,inquiry,physical examination,identification and etc,all these have some problems.Therefore,the conclusion of lie detection can’t be classified to any existed kind of evidence.But the scientificity of this technology has been generally recognized,it can be used properly for excluding innocent suspects,finding the clue,clearing the direction of investigation,solving difficulties of interrogation and examing the authenticity of the confession.To let the technology of lie detection better serve the judicial practice,it is necessary to establish and perfect relevant systems,improve the level and strenthen the management of technicians,and draw lessons from international experts’ principal of admissibility.
