A Study On The Improvement Of The Internet Financial Credit Legal System

With the rapid growth and popularity of internet and requirements for the construction of social credit system,the Internet financial credit bureaus arise at the historic moment,which changed the development patterns and features of traditional credit business and created a new development mode in China’s credit investigation field.At present,China has preliminarily formed the credit legal framework,which mainly consists of administrative regulations and departmental rules,and also comprises other normative documents,such as local government regulations.The framework simply refers to the relevant laws on traditional credit investigation industry and fails to provide effective supervision of the behavior of market main body.Based on the development characteristics of the Internet financial credit investigation industry,it is necessary to make laws and regulations on Internet financial credit investigation field.This article is divided into four parts: firstly,the Internet financial credit investigation related theory is introduced,then the problems of the Internet financial credit investigation system are discussed,and the credit development experience of the United States is comparatively analyzed afterwards,finally some suggestion on the improvement of China’s Internet financial credit investigation system are offered.In the aspect of problem analysis,the weaknesses of relevant laws and regulations and information sharing and supervision are discussed.With respect to introducing the American development experience,the paper introduces the American credit legal system and market development status,and summarizes the general practice for reference.For the improvement measures of the Internet financial credit investigation system,relevant rules and system should be set up in many aspects to clarify the operation direction of the Internet financial credit investigation industry,such as credit investigation laws,sharing of information data,protection and supervision of the information subject interests,and the credit investigation industry operation mode.
