A Research On The Principle Of Equity Interest Under Environmental Collision Avoidance

With the urbanization of our country,public can obtain information in multiple ways.The management mode of the government has changed from the extensive centralized management mode to the multi-subject governance mode.Public sense of democracy has developed greatly.Environmental emergencies and other environmental problems happened from time to time because of environmental conflict avoidance.For example,some public infrastructure such as refuse processing plant,generator,sewage plant and gas station will have some inevitable influence to civilians nearby.If these aftermaths can not be handled properly,it will deteriorate into a boycott against government.This boycott must be solved seriously during the brutalization process,because it has a great damage to social stability and economic development.The reason of environmental collision avoidance is very complicated.Therefore,this essay will analysis the reason in terms of individual interest,group interest and public interest.With the knowledge of jurisprudence,administration,sociology,Environmental Law,this essay will summarize the potential problems among many interest groups under environmental collision avoidance.And focus on how to deal with these problems.This essay will be divided into five basic parts:Part One: Brief introduction of environmental conflict avoidance.Part Two: The theoretical illustration,focus on concept,theoretical principle and judicial regulations etc.Part Three: Analysis the potential conflict among many interest groups under environmental collision avoidance.And then illustrate the behaviour of them via actual samples.Summarize the conflict among individual interests,group interests and public interests.Part Four: Illustrate the reason of environmental collision avoidance in four aspects.First is focus on difference in terms of perception of risk among stakeholders,including government enterprise residents.Second is focus on the shortage in the operability of environmental conflict avoidance balance of interests,such as subjective arbitrariness in interest measurement,complicating interest relationship,and irrational interest measurement.Third is focus on the disadvantages in terms of public participation.For example,the government is too crude in the decision-making process,and the barriers of cooperation between the government and the public.Forth is about government's problem on how to deal with environmental collision avoidance.The last section is about solution towards this problem.For example,shaping new risk communication mechanism of cooperation,setting up multiple interest measurement standard,developing public participation and consolidating the mechanism of the government to avoid conflicts in the environment.
