The Conflict And Adjustment Between The Customary Of Kazakh Marriage Family And The Statute Law

The customary law of ethnic minorities still exists in the daily lives of various ethnic minorities in China.In particular,customary laws in the field of private law have a greater influence on the people of all ethnic groups.Paying attention to the customary law of ethnic minorities and studying them.On the one hand,it is conducive to understanding the different legal ideas of ethnic minorities in China and learning about the advantages and disadvantages of them.On the other hand,it is conducive to the smooth resolution of the process of the enactment and implementation of national statutes.The conflict between the national statutory law and the customary law of ethnic minorities has promoted the smooth progress of China's rule of law construction throughout the country and promoted social stability and economic development in ethnic minority areas.The Kazakh people are the most important nomadic people in the Xinjiang region.The Kazakh people have a long history and culture,and they have a customary law with their own ethnic characteristics.This article mainly studied the Kazakh marriage and family customary;first of all,it started with the customary law of ethnic minorities,discussed the concept,characteristics and value of minority customary law,and then entered into the important customary of marriage and family in minority customary law;The main content of the Kazakh marriage and family customary,in this process,we can find that there are differences between the provisions of the Kazakh marriage and family customary and the provisions of the statute law;after that,the Kazakh marriage and family customary and the statutory law conflicting part are discussed.Finally,it discussed how to adjust the two,mainly including the abolition of unreasonable provisions in customary law,the exercise of legislative autonomy,and the application of customary law in judicial practice.
