Research On China's Legislative Hearing System

In today's world,most countries choose the rule of law as the strategy of statecraft,which is the irreversible return of the world trend.The rule of good law is a good medicine for the rule of law.There is no doubt that public participation in legislation is an important part of making good law.The legislative hearing system is the concrete form of public participation in legislation.It pursues the core value of democratic rule of law and forms the democratic will in the process of public equal participation in legislative activities.So the legislative hearing system in our country there is practical significance lies in the true realization of the people are masters of the country,safeguard citizens' legal rights,limit the abuse of public power,strengthen the supervision of the legislature,public eventually improve the democracy of legislative activities,the legitimacy of the legislation and the legislative content is scientific.This article through the analysis of the basic theories of legislative hearing system in our country,and combining the relevant legislative hearing system of legal theory and legislation of our country hearing system analyzes some shortcomings existing in the practice and reflection,in order to can for our country propose legislative hearing system in the present dilemma.This paper is divided into four parts,and discusses the dilemma and suggestion of China's legislative hearing system.The first part is the overview of the basic theories of legislative hearing system in our country,through the grasp of the concept of legislative hearing system,understand the connotation of the legislative hearing system in our country,also analysis the necessity of our country to set up the legislative hearing system,grasp the significance of the legislative hearing system in our country legislative activities.The second part is a legal basis of the legislative hearing system in our country,by the theory of law,the core value of the spirit of the law of the legislative hearing system,deepen the understanding of the legislative hearing system,to below the legislative hearing system in our country give guidance for the problems in practice.The third part points out the existing problems in the legislative hearing system in our country,this paper from the aspect of law,legislative hearing procedure and the supervision of the legislative hearing,and a series of problems,in order to can specifically analyze the legislative hearing system in our country,and to give attention to two or morethings arrives the legislative hearing system in our country as a whole.The fourth part is the corresponding countermeasure to the above mentioned problems.This a series of problems are the current problem to be solved to perfect our legislation hearing system,this paper tries to start from the "thin",in the legal construction,the perfection of legislative hearing procedure rules and supervision has made a suggestion,hoping that the countermeasures to solve the problem can help in the development of the legislative hearing system in our country.
