In recent years,the gross merchandise volume and settlement volume through online payment have been constantly increased.As virtual transactions can't rely solely on honesty and credit,and the online banking platforms are inconvenient for major banks to make cooperation,the third-party payment with strong capital has emerged.The ecommerce platform in our country is thriving and the trading volume of e-commerce platform is large,which made the continuous expansion of the third-party payment market.With the expansion of various consumer goods e-commerce platforms,the third-party payment industry has thrived to become an indispensable part of the process of online financial operation.Therefore,the development of the industry needs to be regulated by law and related regulatory system.China has promulgated the relevant legal systems such as the "Guidelines for Electronic Payment(No.1)",the "Electronic Signature Law" and the "Administrative Measures on Payment and Liquidation Organization" too fill the gap of legal supervision in the field of third-party payment,but it has to be pointed out the third-party payment of legislation in this area is not sound enough,the relevant issues still exist.Based on the civil area the third-party payment involved,this paper analyzes and studies the civil law issues involving third-party payment in our country.It0 expounds the concept and characteristics of the third party payment in detail,as well as the civil legal relations with banks,buyers and sellers in the third party payment process.It also analyzes the development of third party payment in our country and the civil liability,thus finding out there are problems of the status of the payment in our country,the regulation of deposit funds and the privacy protection of consumers and other issues.Therefore we studied the successful case of the third-party payment legislation in other countries such as the United States,the European Union and Singapore.According to the feature of the weak theoretical research on the third-party payment field in our country and the imperfection of the actual legislation,we put forward the strategy of perfecting the third-party payment of civil law rules,That is,to establish the legal status of third-party payment status,strengthen the management of sedimentary money and further safeguard the rights and interests of consumers and other legislative suggestions that suit China's national conditions so as to promote the sustained and stable development of third-party payment in China.
