Study On Several Issues Of Transferred Robbery

Throughout the current research situation of criminal law in our country,there are still many controversies about the crime of transferred robbery.Due to the limited level of the author,this article can not cover all the controversial contents.This article is mainly divided into three parts for analysis.In the first chapter,this article mainly discusses the summary of the crime of transforming robbery.First of all,it discusses the concept of the crime and its crime.Secondly,by comparing Article 252 of the German Criminal Law and Article 283 of the Japanese Criminal Law,we describe the differences with Article 296 of the Chinese Criminal Law.Finally,we will sort out the legislative value of the conversion robbery crime.This article summarizes three reasons.In the second chapter,this article focuses on the objective elements of the crime of transferred robbery.First of all,it investigates the role of theft,fraud and robbery in transferred robbery and the possibility of other crimes surviving into robbery.,By comparing the existing doctrine,from many viewpoints,discusses the views of this article.Secondly,it analyzes the cognizance of the spot,a space factor,in this crime and discusses the extent of violence and the object of its implementation.The third chapter mainly studies the attempted crime of transferred robbery.Among them,firstly,the article introduces whether there is attempted crime in trans-type robbery in Germany and Japan,and leads to two opinions on whether our country approves this question or not.Second,we should put an end to Japan’s position crime and the two doctrines combined,Analyzes the starting point of conversion-type robbery crime;finally,introduces the standards of accomplishing the crime of transferred robbery in Japan and China’s existing doctrines,and analyzes the rationality and inadequacies of various theories.Through comparative studies,this article considers the reasonable judgment standard.In the fourth chapter,we study the problem of accomplice of transferred robbery.First of all,it introduces the theory of Japan concerning the problem of Accomplice of transferred Robbery,compares the existing theory of Accomplice of Accomplice and Identity Theory and Accomplishments in Japan,and analyzes the rationality and insufficiency of both theories.Secondly,in view of the special situation of transferred robbery in our country’s practice,combined with the case,we put forward our own opinions on the issue of accomplice of transferred robbery.
