| In 2015,China amended the legislative law to decentralization of local legislation to all districts.The number of local legislative powers increased from 49 to 282 at the municipal level.The increase of the legislative body has changed the local legislative pattern of China,and it also made a great influence on the current legislative supervision mechanism of our country.After that,the local organization law has also made a similar revision,adding a series of contents to the municipal legislation of the district.In 2018,National People’s Congress adopted the amendment to the constitution of the People’s Republic of China.So far,the district officially became the local legislative body recognized by the constitution.According to the provisions of the constitution,the legislative law and the local organization law,the supervision of the provincial people’s Congress plays an important role,and it is an indispensable part of the legislative supervision system.However,the supervisory mechanism of the provincial people’s Congress has many problems,such as unclear oversight responsibilities,lack of necessary authority in supervision and specific regulations.In order to improve the legislative level of the city,it is urgent for the provincial people’s Congress to improve its supervision mechanism.First of all,it needs to clarify the concept of relevant laws,supervision mode belongs clearly Provincial People’s Congress and its Standing Committee,and understand the various characteristics of the mode of the supervision of the provincial people’s Congress,so as to find out the advantages and disadvantages of the supervision mode,;secondly,analyzing the connotation of the provincial people’s Congress and the scope of the various monitoring methods in order to present,the supervision measures are in place,the right of supervision and actively exercise law;thirdly,discuss the different methods of supervision of the provincial people’s Congress,understanding the existing legal provisions of Provincial People’s Congress Supervision districts legislation results from the perspective of the fundamental significance of supervision;finally,supervision of the provincial people’s Congress must improve from the theory return to practice,through the existing Provincial People’s Congress supervision of the understanding of the problem,try to use a variety of solutions.For example,we should give a more detailed explanation of vague legal concepts,and promote the establishment of special oversight committees for municipal legislation,so as to improve the professionalism and effectiveness of supervision from various perspectives.In short,under the background of the revision of the Constitution and the expansion of the local legislative power,the legislation of the municipal legislation of the district is of great significance for the construction of our legal system.Compared with the rapid development of local legislation,the supervision of the provincial people’s Congress is slightly inadequate.In order to ensure the orderly development of the municipal legislation of the District,the supervision of the provincial people’s Congress needs to be strengthened,and the way of supervision is needed to be adjusted. |
