Research On The Copyright Issues Used By Graduates’ Dissertations

The dissertation can not only reflect the degree of graduates’ mastery of theoretical foundation and professional knowledge,but also represents the most avant-garde development in a certain field,and can reflect the work attitude and ability of graduates to engage in scientific research and work independently.At the same time it is also a measure of the quality of a school’s award of a degree.With the continuous expansion and deepening of the sharing of computer technology,network,and documentation information resources in the era of big data,the use and dissemination of resources for graduate degree thesis are more extensive and frequent.However,in practice,the ownership of the dissertation copyright under many specific circumstances is not yet clear.Scholars and legal workers have not yet reached a complete consensus on the ownership of the graduate dissertation under certain circumstances.The dissertation resources are in use.There are also problems such as uncleared license agreement or unclear contents of the agreement,incomplete development and utilization mechanism of the paper.In the article,the author expounds the risks of copyright infringement in the use and management of dissertations,introduces foreign dissertation management experience,and proposes the following suggestions for the defects of the dissertation management system in China and copyright issues arising in use.: Improve China’s dissertation typed legislation;Improve China’s dissertation management system,management model,and degree-granting unit’s copyright policy;Rationally plan the construction of dissertation resource base,establish a unified collection system,and unify the dissertation’s metadata standard,establish a unified Electronic degree thesis platform.This article studies relevant literature,finds related cases,and combines comparative analysis and case analysis methods.The body of this paper is divided into five parts:The first part is the introduction.In recent years,more and more college graduates have begun to awaken the consciousness of copyright dissertation maintenance of dissertations.However,the copyright protection system for graduate dissertations of our graduates is still far from perfect and mature.We need to pass on copyright ownership status and resources for the use of dissertations in China.The status quo of the exploitation of exploitation is discussed,and the method of balancing rights holders with schools,enterprises,and the public is found in combination with typical foreign experience and the specific situation in China.In addition to improving the copyright protection system for our dissertations,we will continue to deepen the development and utilization of the social value and economic value of paper resources.The second part expounds the attributes of graduate dissertations,which mainly include the concept,classification and characteristics of dissertations.The five characteristics of the dissertation work in China are introduced with emphasis: certain depth and value of scientific theory,higher originality,certain scientific nature,strictness and standardization,certain applicability and social value.It shows that the dissertation contains high academic value and even economic value.It is necessary to perfect the protection system of creator’s rights in China,and then to tap the various potentials of dissertation resources.The third part is the key point of this paper.It briefly analyzes the ownership of the copyright of the graduate thesis work used in the current stage,the infringement risk of the authorized use of the thesis work,and the protection of the copyright of the dissertation of the digital library era.A number of legal issues were compared with the current situation of the use of resources in China’s dissertations,and the causes of certain copyright legal issues arising from the use of dissertations were analyzed.This section focuses on issues related to the incomplete ownership of copyright,the infringement of copyright in the process of collection and dissemination of digital libraries,and the non-conformity of authorizing and delegating authorizations in the use of works of Chinese graduate thesis.Exploring the specific causes of the problems will pave the way for the proposed countermeasures to address the issue of the copyright of graduates’ dissertations.At the same time,through copyright-related representative cases,the general situation of the use of copyright in graduate dissertation works is analyzed,and several legal issues concerning the management of university dissertation copyrights and the authorization of unauthorized distribu-tion of infringement disputes under non-standard conditions are examined.The fourth part is the analysis of the status quo and the development of the thesis development of the UK,the United States,India,and Russia,which are relatively mature countries in the management and development of
