The harm of drugs is self-evident.On the one hand,it causes physical abuse to drug addicts.On the other hand,it also afflicts people with mental illness.Furthermore,it may have a negative impact on society and lead to unstable situations.Turmoil,of course,can also cause public panic.China has always attached great importance to a series of issues concerning drug-related crimes.With the introduction of various laws and regulations and judicial interpretations,it has provided a basis for such crimes.In addition,a great deal of experience accumulated by academics and practitioners over the years has helped to combat and punish such crimes.However,most of the research on drug crimes is focused on those major crimes.There is not much involved in the part discussed in this article.This has led to controversies in specific cases and inaccurate situations.In addition,in reality,this type of crime is complicated,A series of problems,such as change,brought certain difficulties to the judicial practice department in handling cases,made clear the legal intent,discussed the rules and regulations,and became the need for the construction of the rule of law in China.This article starts from the study of the crime of keeping other people in drug crime,based on the starting point of conviction,analyzes some special problems in the subject,behavior,and conviction standards,and analyzes the problem briefly in the light of typical cases.In addition to the introduction and conclusions,this article is divided into four chapters:The first chapter mainly introduces some basic theories that may be involved in the crime of drug abuse for others,such as its meaning,legislative evolution,and so on.It also gives an introduction to the research status of extraterritoriality,which will pave the way for subsequent discussion.The second chapter starts with the identification of several types of special subjects that allow other people to use drugs,specifically discusses how to define the participants and how the unit commits such crimes,and carries out a systematic combing of this type of crime.The third chapter focuses on the study of the conduct of detention for drug abuse,ie,whether it is an act or an omission.How to determine the neutral help behavior?The fourth chapter focuses on issues related to the conviction standard for the crime of detention of other people,such as the understanding of “multiple times” and the comparison of “multiple” determinations in theft.
