| This thesis mainly focuses upon the copyright protection of newspapering.Firstly it introduces its present situation and significance of newspaper;secondly it analyzes the legal environment on copyright protection;thirdly the thesis makes a practical exploration into the actual copyright problems after identifying and combing the legal issues in the process of copyright protection;lastly it provides a solution and guide for developing better copyright maintenance.As far as the present situation of copyright protection is concerned,a lot of copyrighted works authorized by the Press Group are illegally applied by other commercial websites,media platform,individuals and other organizations,resulting in large copyright revenue loss;on the other hand,the Press Group has to pay high copyright fees if legally running its business and legally applying others’ works.As a result,this paper puts forward the viewpoint to promote healthy development of the Press Group,which is as follows: by means of strengthening the power of legal copyright protection,the Press Group can improve its copyright protection,copyright operating earnings,advance new ideas and cultural innovation,and push forward the healthy development of the copyright and journalism industry.In the analysis of legal environment,the thesis firstly makes an analysis of the historical evolution of copyright protection,developing from nothing to existence,and provides the legal guarantee for copyright protection with the continuous perfection of legal system.Meanwhile,it proposes the points: to establish the specialized intellectual property court in the judicial practice;provide a judicial precedent and intensify the punishment of infringing copyright,all of which promote the copyright protection and the perfection of mechanism.In the respect of legal issues involving copyright protection,this paper makes a study of the following issues in the legal copyright of the Press Group: the proprietary rights of its own published works,the copyright protection of news works,the rights of the copyright owner,the authorized transaction of copyright,infringement and constitutive requirements,legal liability and other aspects of the problems.And it also presents the contents: the premise of copyright protection is to identify the copyright Press Group,to enrich the news by reasonably using the copyright,the journalistic works without creative labor are not protected by law,and maintaining the legal rights conveniently by grasping the elements of infringement and compensation standards.As regards how to launch the copyright protection,this thesis proposes the establishment of internal management mechanism in the newspaper group,the running process’ optimization,the strategic application of copyright protection,the establishment of copyright supportive mechanism,and other solutions as well.A division of labor cooperation mechanism should be set up to guarantee the management mechanism,to coordinate the copyright registration,content management,violation monitoring,and operating rights.In the process of copyright protection,three measures are strictly taken,they are as follows: “clarification of right,protection of rights,application of rights”,which presents the concrete methods and implementation plan of different stages.In the strategic use of copyright protection,this paper puts forward the perspective of taking the works’ copyright as an asset management,meanwhile offers the view that the copyright monitoring is the focus of protection,into which more investment should be put.In addition,it also points out that running is the focus of copyright protection,works creation and prevention of infringement should be encouraged.Finally,this paper proposes that the decision-making mechanism,internal coordination mechanism and external coordination lay the basis of protecting the copyright,with the support of finance,industry organizations,professional protection and the institutional cooperation at the same time. |
