The power of law enforcement means the power including unilateralism,compulsion and enforcement polices use when they execute their duty following the law.The duty of police is composed by legislative and social functions.Police are supposed to use the law enforcement only during they execute the legislative function.In other word,duty execution of police does not mean police should use law enforcement.During executing the legislative function,police should follow the legislative spirit,keep social stability,use the power of law enforcement carefully and take the social management into account.However,police are easy to use more or less the power of law enforcement in practice.Besides deciding whether police should use the law enforcement,police should take the refection and tolerance of people into account.The main factors which effect the degree of using the power of law enforcement are the target,directivity and the influence.The target effects whether police should use the power of law enforcement,which is key factor.The target includes who behave violence,which determines who should be used the power of law enforcement,and the legal interest for the victim,which determines the object should be protected.The directivity concerns the relationship between the intimacy and the tolerance.In general,a citizen is allowed tolerate the violent behavior by himself.Organization will tolerate the inside violent behavior,while the organization will not tolerate the outside violent behavior and as a result,police should take action.The influence of violence also effects whether police will use the power of law enforcement.With serious impact comes more power of law enforcement.In addition,the urgency of violence effects the speed of using the power of law enforcement.In practice,the degree of using the power of law enforcement is based on the whole condition,the dynamic rule of enforcement and the possible result.In addition,police should utilize the original order,multiple units in the organization and limited self-control space involved.If police try to realize it,polices' authority will be established,harmony relation between polices and citizen will be built and social cohesion will be reached.
