Research On The Prevention And Control Of Drug Driving In China

Currently,the phenomenon of drugged driving in China has become increasingly prevalent,which seriously impairs the health of citizens and causes threats to the security of public and private property,affecting the harmonious and stable development of our society.In response to this critical issue,the author collects altogether 481 cases related to drugged driving from both the China Judgements Online between January 1,2014 and December 31,2017,and from the news reports in 2017.By applying the data software for a statistical analysis of these cases,the author summarizes the current status,characteristics,existing problems and causes in relation to the prevention and control of drugged driving in China and comes up with corresponding improvement measures to provide a theoretical and practical reference for the prevention and control of drugged driving in China.Apart from the introduction and conclusions,this paper is divided into four parts:The first part provides an overview of drugged driving.The definition and characteristics of drugged driving are elaborated,taking into consideration of both the current laws and realities in China.It also gives analyses of the status quo and characteristics of drugged driving on the basis of the statistics about 481 cases both published by the China Judgements Online from 2014 to 2017 and released by news reports in 2017.The second part describes the current status of the prevention and control of drugged driving in China.This paper sums up the current situations of the prevention and control of drugged driving in China,covering the perspectives of legislation,administrative laws and regulations,departmental rules,local legislation rules,management and control from the functional departments such as the departments of traffic control,drug control,public security and criminal investigation,as well as the prevention and control from social forces etc.The third part is the analysis of the existing problems and causes of the drugged driving in China.According to the current situation of the prevention and control in China,it reveals and analyzes the causes to the existing problems and deficiencies from the four aspects of legislation,management and control of the functional departments,prevention and control of social forces,and personal factors of drivers,so as to provide targeted improvement measures in the next part.The fourth part is about the improvement of the measures taken in the prevention and control of drugged driving in China.Learning from the successful experiences of foreign countries while combining actual situations in China,this paper discuss the prevention and control measures of drugged driving from the aspects of formulating and improving the legislation system,improving the prevention and control mechanism of the functional departments,guiding the social forces to participate in the prevention and control,as well as strengthening the monitoring and education on the drivers themselves,in order to effectively solve the problem of drugged driving.
