The Study On The Operation Of The Oceanic Police Power

Since the integration of the China Coast Guard in 2013,the power of the oceanic police has been an important content of the research of coast guard.However,a lot of scholars have mentioned the oceanic police power,the conception is still indistinct and the exploration of the factors that affect the operation of the oceanic police power are needed to be researched further.With the new institutional reform published in 2018,China Coast Guard was incorporated into the Chinese People's Armed Police Force.The practice should work in concert with the theory.Therefore,it's necessary to conduct on a research about the nature,range,configuration and the operation of the oceanic police power.The proper meaning of the oceanic police power will be found,and the factor affecting the operation of the oceanic police power will be researched in this paper.The paper was divided into four parts.The first part is the definition of the oceanic police power.The conception of the oceanic police and the oceanic police power will be defined in this paper.We will make a different between the oceanic police power and the police power.We will also discuss the different between the oceanic police power and the law enforcement power on the sea.The second part is the frontier of the operation of oceanic police power.However,the found of China Coast Guard made the end of the duplicate law enforcement,there are still some departments that have administrative obligation on the sea.The police is obliged to attack the violation of law on the seacoast.The duty of safeguard legal rights will obscure the frontier of oceanic police power and military power.We will make it clear by comparing the authority of the three.The frontier between the oceanic police power and the private rights will be made clear,which is also a key to the operation of the oceanic police power.The third part is about the own factor that affect the operation of the oceanic police power.We will analysis the principal,content and the legal basis of configuration,in order to find the proper way of configuration.The forth part is the discussion of the external factor of the oceanic police power's operation.In this part,the legal basis of the operation,international situation,people and equipment which are important to the operation of the oceanic police power will be discussed.This articles considers that the oceanic police power is a kind of violent police power which operates on the sea.The oceanic police power is different from the military power,and doesn't have the military property.Based on the important meaning of sea power control,the sea power property is the fundamental nature of the oceanic police power.For it's nature,the concept and the principle of the operation of the oceanic police power should express the national interests.The operation is also influenced by the policy and the international situation.The operation of the oceanic police power needs advanced equipment and specialized persons because of the boundless sea and the professional problem.
